“Twin Peaks March Mania Bracket” Contest Official Rules

 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

 

The Men’s College Basketball Tournament starts March 19, 2015, at 12:00:00 p.m. (Noon) Eastern Time (“ET”), and runs through the championship game which will be played on April 6, 2015.

 

The Twin Peaks March Mania Bracket Contest (“Contest”) will be broken out into two (2) parts: (1) a national contest which is sponsored by Aptivada LLC (“National Contest”); and (2) a local contest which is sponsored by KUPD-FM (“Local Contest”). The National Contest and Local Contest together will be referred to as the “Contest.” The Contest is subject to all applicable federal, state and local laws.

 

Sponsors: The sponsor of the National Contest is Aptivada, LLC; and the sponsor of the Local Contest is KUPD-FM, located at 1900 West Carmen, Tempe, Arizona (collectively, “Sponsors”).

 

How to Play: To participate in the Contest, beginning at 6:00 p.m. on Sunday, March 15, 2015, entrants can go to www.98kupd.com/marchmania” to register, or register via KUPD-FM’s Facebook page. ONE REGISTRATION PER PERSON, PER HOUSEHOLD.

 

Bracket pairings are announced on www.98kupd.com or on the KUPD-FM Facebook page (collectively, the “Website”) on March 15, 2015 at or about 6:00 p.m. MT. The complete bracket pairings will be available for all registered participants (hereinafter, “Players”). At this time, each Player will be allowed to register by logging in and making their selections for each bracket for their chance to win. Each Player must fully complete the registration process before making bracket selections. The deadline to make all selections is March 19, 2015 at 12:00 p.m. (Noon) MT (“Bracket Deadline”). All picks must be successfully saved by or before the Bracket Deadline. Any picks that occur after the Bracket Deadline will not count and the Player will be disqualified.

 

For each bracket, each Player can make his/her selection by clicking on the team the Player thinks will win each match-up for each round. Only teams a Player selects will go on to the next round of play. Players shall continue making their picks for each round until the Player has made a total of 63 picks, including the winner of the championship game. Each Player must complete the entire bracket by the Bracket Deadline to be eligible enter the Contest. However, each Player will not be required to pick the winners of the “First Four” play-in games. Once a Player submits his/her selections by the Bracket Deadline, he/she will be asked to choose scores for a designated tie-breaker match-up, which will only be used in the event of a tie between Players. The sections on Tiebreaker and Contest Scoring is explained below.

 

This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook. By participating, a Player is submitting information to Sponsors and not to Facebook. By playing, each Player releases Facebook from any responsibility or liability for the Contest.

 

Winner Selection: Players are ranked according to their cumulative point score (as explained in the Contest Scoring section below). The Player with the most points at the end of the round will be deemed the round winner, subject to verification. The Player with the highest number of cumulative points at the end of all rounds will be deemed the Grand Prize winner, subject to verification of eligibility.

 

Contest Scoring: The Contest is scored based on the 6 rounds of the Men’s College Basketball Tournament. The tournament consists of 6 rounds and point totals are awarded differently for correct picks in each round, as follows:

 

            Round 1: 100 points/each correct pick;

            Round 2: 200 points/each correct pick;

            Round 3: 400 points/each correct pick;

            Round 4: 800 points/each correct pick;

            Round 5: 1600 points/each correct pick;

            Final Round: 3200 points correct pick

 

Tie-breakers: In the event of a tie between two (2) or more Players, the winner will be determined using a tiebreaker formula. Each Player will choose a score for a designated matchup (the “Tiebreaker Matchup”). The absolute value of the difference between the chosen and actual score for tiebreaker team #1 is added to the absolute value of the difference between the chosen and actual score for tiebreaker team #2, then this value will be subtracted from the possible baseline tiebreaker points of 99(ninety-nine). If the remaining tiebreaker points are less than 1, then 1 tiebreaker point will be used. The player’s tiebreaker points will be appended to the actual score through each round, and will be a part of the overall score as well. If a tie still exists after using the tiebreaker formula then a random winner will be chosen from the pool of tied players.

 

National Contest Prize Winner(s):

 

Grand Prize: Any Player who selects a valid perfect bracket (the correct selection of all 63 matchups) by the Bracket Deadline will receive $50,000. If more than one (1) Player correctly picks all 63 games correctly, the $50,000 cash prize will be evenly divided and distributed among all winning Players (including Players who participate in the Contest through another Sponsor other than KUPD-FM) who correctly picked all 63 games by the Bracket Deadline. The payment will be within 90 days of receiving valid user ID forms and verifying bracket and all eligibility requirements of any and all winners. $50,000 payable from Aptivada, LLC.

 

Local Contest Prize: KUPD-FM will have one local winner to be determined at the end of the contest. The winner will be the entrant who has the highest number of cumulative points at the end of all rounds (a “Local Winner”); in the event of tie, KUPD-FM will use the Tiebreaker formula set forth above to determine who is the Local Winner from among all tying entrants. The Local Winner will receive $500.

 

Prize winners are responsible for all applicable taxes which may be incurred by winning the Prize. The Prizes consist of only those items specifically listed as part of the Prize. All prizes are non-transferable and non-assignable. No cash redemption or prize substitution allowed by the Prize winners. Sponsor reserves the right to substitute a prize of equal or greater value if any Prize is unavailable and/or undeliverable for any reason in the sole and complete discretion of Sponsor.

Local Contest Eligibility. Individuals must be 18 years or older to be eligible to participate and win a prize in this contest and must have permanent residence in Arizona, stationed at a military installation or be a valid full-time student registered at a campus, university or educational institution within the same area. You are not eligible to enter this sweepstakes if you or a member of your immediate family works for KUPD-FM, Hubbard Radio Phoenix, LLC, Hubbard Radio, LLC and Twin Peaks Restaurants, or any of these companies’ parent or related companies, subsidiaries, affiliates, or advertising agencies, or employees of other radio or television station in the Phoenix area, or their immediate families of any such person are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, whether as “in-laws” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

 

Claiming a Local Prize. The Local Contest Winner must claim his/her prize in person at the KUPD-FM Offices, 1900 West Carmen, Tempe, Arizona, Monday through Friday, between 9:00 a.m. and 5:00 p.m., within ten (10) days of the day he/she wins the prize or prize may be forfeited and awarded to an alternate, time permitting. When claiming a prize, the Local Winner must prove he or she is a qualified winner by presenting identification acceptable to the sponsors (e.g., state driver’s license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification) and Social Security Number. If a Local Winner cannot prove he or she is a qualified winner, the prize will not be awarded.

 

Claiming the National Grand Prize. If any Player had a perfect bracket, he/she will be notified by telephone and/or email that they are a potential Grand Prize winner by Aptivada, LLC. Aptivada LLC will make up to three (3) attempts to contact such potential Grand Prize winner. If potential Grand prize winner cannot be reach after three (3) attempts, he/she may be disqualified at Aptivada’s sole discretion. Upon responding to the winner notification, Aptivada will send each potential winner an Affidavit of Eligibility and Publicity/Liability Release, each of which must be completed, signed and returned within forty-eight (48) hours from date of issuance, or the prize will be forfeited. If any prize notification or attempted notification is returned as undeliverable, the prize may be forfeited.

 

Data Collection/Privacy. Information collected in this Contest will be administered by Sponsor in accordance with its Privacy Policy, located on www.98kupd.com.

 

Other Conditions: Mass Entries or Entries generated by a script, macro or use of automated methods will be disqualified. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. If cancelled, Sponsors reserve the right in their sole discretion to determine the winners (if any) using all non-suspect eligible Players scores accumulated up to the time of cancellation. Sponsors, Twin Peaks Restaurant and Facebook, are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, or software; failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Sweepstakes. In the event of a dispute over an electronic entry, prize will be awarded to the owner of the email address, not the name provided during registration. All registrations become the sole property of the Sponsor and will not be acknowledged or returned. Incomplete and duplicate registrations will be disqualified. All federal, state and local laws and regulations apply. In addition to the instances set forth above, Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest; (b) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these rules; or (c) the Contest is otherwise not capable of running as planned. By entering, Players agree to release and hold harmless Sponsors, Twin Peaks Restaurants Facebook, and each of their parents, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, contractors, subcontractors, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the ‘‘Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance, delivery, or use of any prize, including without limitation, the Grand Prize. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Contest, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of Entries and/or entry information, or (vi)  registrations or entries which are late, lost, stolen, damaged, illegible and/or unintelligible (or any combination thereof). By entering, entrants agree to comply with these Official Rules. Any entrant who attempts to tamper with this Contest in any way shall be disqualified. Additional restrictions may apply.

Arbitration/Choice of Law: Except where prohibited by law, Players agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by entrant with regard to this Contest and shall exclude in all events attorneys’ or other related fees and punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsors in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Arizona or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Arizona. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
