Former Korn Drummer Arrested for DUI: Claims No Alcohol in System

I remember a time in my foolish youth where I downed a 12-pack of beer all on my own, hopped in the car buzzing like a bee to pick up more booze, only to be pulled over by a cop for speeding. What did he do to me? Nothing.  Why? Because I'm a genius.

Actually, I probably didn't down a whole 12-pack of beer, but I did get into my car and drove drunk.  When I was pulled over by the cop, I have to thank my lucky stars that I didn't get arrested right there on the spot. Thinking back, I'm pretty sure that when he asked for my driver's license, I fetched it from my wallet only to clumsily drop it out the window.  When he asked if I had been drinking, I told him I was working a lot of hours and that was the reason I looked so tired. As it is, I look tired even when I'm sober. It's kind of a gift.  I digress...

By the time the cop came back to my car, he cited me for speeding and my only punishment was to attend traffic school.  This experience would be the last time I ever drove drunk and I would consider paying the money for traffic school a much lesser penalty than spending it in Tent City.

Now that I'm older, I know that lame excuses like that don't work anymore. It's bad enough I'm getting pulled over on my foot's own volition, not from intoxication. 

However, there are still people out there who are my close to my age still using lame excuses hoping it gives them a Hall Pass from being detained.  Kinda like former Korn drummer, David Silveria, who was arrested on Sunday in Huntington Beach, CA for being under the influence. The facts state that Silveria rear-ended another car while he was on his way to breakfast. When the cops arrived, they asked him if he had been drinking only to have Silveria mention that he had a sleeping pill or two from the night before.  This statement red-flagged the cops and prompted them to continue with a breathalyzer test in which Silveria blew a 0.0.  He was still detained for being intoxicated under medication.

TMZ.com reported that Silveria continues to stand by his word by saying he didn't have a drop to drink, rather, made an "honest mistake" by taking sleeping pills from the night before.

OK, so maybe Silveria isn't so much of an idiot for using that excuse. The way I see it, I was far more of an idiot when I was 24 and drinking and driving under the influence.  As a 39 year-old man, it seems apparent to me that Silveria has nothing to really hide considering he no longer drums for Korn and doesn't really have any type of reputation to keep.  In this case, I would give him a short Hall Pass for about five minutes and still give major kudos to the HBPD for keeping him detained. Bravo.  

Considering that Silveria knew he was under the influence of some type of sleeping pill doesn't excuse him from the fact that he knew he should have taken his prescribed pills 8 hours prior to waking up and getting in the car. In my experience with sleeping pills I know they make you sleep for the full 8 hours only to wake up feeling refreshed.  Anytime I woke up an hour or two before the drug had worn off, I'd find myself in a cloud only to have the start of my day feel like it was dragging on forever.  Oh, and I know I'm not the only one this has happened to.

Mika Oqually - Innocent in all this? No way. He's an awesome guy and all but theres no shame in admiting you made a mistake (besides that feeling of wanting to punch yourself for being so stupid). It sucks hes being detained but oh well he made his bed now he has to sleep in it
